Low Fell Hire Company - Terms
Terms and Conditions (Weddings)
This contract is between the client & Low Fell Hire Company. It covers the provision of hired items and services illustrated in the invoice provided.
A booking is confirmed when the client has paid 25% of the deposit to Low Fell Hire Company as well as the delivery charge. You will then receive confirmation from Low Fell Hire Company that your products/ date has been reserved. We do have a £150 minimum spend on our products, which is excluding delivery.
Any prices quoted upon enquiring, are valid for 14 days from receiving the quote.
Payment Terms
Once an order has been placed & confirmed by Low Fell Hire Company. the following applies:
o1st payment: 25% of the total invoice to secure booking (Non refundable), as well as the delivery charge (paid in full)
o2nd payment: The remaining balance of the invoice must be paid by 28 days prior to the wedding or event.
Option to pay in full initially is also available.
Cancellations
If a client wishes to cancel their order, they must do so in writing, either by letter or email. The order is cancelled once Low Fell Hire Company has received the confirmation and responded to confirm so.
If the event is cancelled after 21 days before the scheduled event date, the remaining balance is payable ALL 1st payments are non refundable . (1st payments are based on the agreed amount at time of booking. No refunds will be due in the event that the order has decreased before the cancelation.)
Changes to your order
If the client wishes to change the booking it must be made in writing, either by letter or email A telephone call will be accepted, but the client will be asked to confirm any changes in writing.
Low Fell Hire Company cannot guarantee that they will be able to provide any product, if the client wishes to change their order. All products are subject to availability. We cannot guarantee that we can change your booking to another date, especially in peak season.
Failure to pay
If the payment is not made within the timescales detailed above, on the invoice or otherwise, this will breach the contract. Low Fell Hire Company will treat the contract as terminated.
If Low Fell Hire Company treats the contract as terminated, any payments made to that date, shall be retained. Any balance will also be payable immediately to Low Fell Hire Company.
Low Fell Hire Company is therefore entitled to reallocate stock without informing the client, should the contract be treated as terminated.
This clause is without prejudice to Low Fell Hire Company’s rights to claim damages from the client in respect of any loss suffered by Low Fell Hire Company.
Damaged, broken and lost items
Damaged items will remain the property of Low Fell Hire Company and a replacement charge will be invoiced to you, the client, for any product that is returned to us damaged.
Lost items will be invoiced to you the client to replace the items.
Any items that are retained by the client will be charged a daily rate for each item per day until the product is returned to Low Fell Hire Company.
Health & Safety
During the hire of our props, if for any reason a bulb needs changing please ensure that the blubs are changed when the prop is unplugged.
The bulbs may get hot, so please do not touch the bulbs when they are switched on and do not remove any of the bulbs until you have allowed them time to cool down.
Please place our props on solid ground to keep them balanced and prevent them from falling over.
When moving our props, please ensure that 2 people carry each letter at a time, as they may be heavy to lift.
If in the unlikely situation that our props are not working, please contact Low Fell Hire Company to fix them, rather than attempting yourself. Working with electrical products can be dangerous.
Please ensure that all extension leads are fully unwound, failure to do so can lead to overheating and potential fire risk.
Our Illuminated props are only allowed outside with prior permission from Low Fell Hire Company this is weather dependant based on our staffs judgement.
Low Fell Hire Company accepts no responsibility for any damage or injury caused by any item hired, goods are under the hirer’s own responsibility.
Hirer specific
It is the responsibility of the hirer(s) to ensure that:
o
- A double plug socket is located near to where the letters/ neon signs need to be placing.
- Access to the venue for parking, unloading and setting up is unrestricted and space is made available for the location at its setup location.
- Low Fell Hire Company are informed of any access restrictions that may impact on point 2. This includes but is not exclusive to stairs, lifts, difficult entrances, parking restriction etc. Additional costs to the hirer maybe incurred if these are not stated at the time of booking.
- Inform Low Fell Hire Company of any changes to access, timings, logistics and setup location.
Low Fell Hire Company reserve the rights to review and update the Terms and Conditions periodically.
THot Tubs.
Do NOT allow young children in the tub unsupervised.
Do NOT have any electrical objects near the hot tub.
Do NOT consume alcohol whilst using the hot tub.
Do NOT use the hot tub whilst under the influence of Drugs or Alcohol
Do NOT use glasses of any description in the hot tub. Plastic glasses are suitable.
Do NOT use the hot tub if you have an infectious disease.
Do NOT enter the hot tub with clothes on, only wear suitable swimming attire.
Do NOT enter the hot tub with footwear on or any other sharp objects.
Do NOT allow animals near the hot tub
Do NOT dive or jump into the hot tub.
Do NOT sit on the sides of the hot tub
Do NOT sit on the hot tub cover.
Do NOT stand, sit or place anything on the motor housing.
Do NOT use the hot tub if pregnant
Do NOT use the hot tub after strenuous exercise
Do NOT turn the hot tub off overnight.
Do NOT under any circumstances try to move the hot tub once installed.
Do NOT empty the hot tub to clean unless we have agreed as air locks will form and it will become unusable.
Do NOT drain down the hot tub at all unless you have spoken to us and we have agreed.
Do NOT remove suction fitting cover, this is to prevent risk of injury to body and/or hair entrapment
DO NOT operate your spa if the suction fitting(s) are broken or missing. The suction fittings in the spa are sized to match specific water flow created by the pump. Never exchange a suction fitting(s) with one rated less than the flow rate marked on the original suction fitting(s).
Do NOT run the lay-z-spa massage whilst the cover is on as this may cause a vacuum.
Do NOT use your spa alone
Do shower before entering the hot tub.
Do put something down to wash or wipe your feet on before entering the hot tub.
Do clean the filters as instructed.
Do keep the water level topped up as instructed. Do not allow the water level to drop below the top of the filter.
Do add chemicals as instructed.
Do keep the thermal cover on when not in use.
Hot Tub Hire Terms and Conditions
When you book a hot tub you agree to adhere to the rules that our hot tub provider stipulates.
We will need a relatively flat area to set up on.
You will become responsible for the hot tub after joint inspection and the T’s & C’s have been signed.
Undersigned renter agrees to release this establishment from any and all liabilities incurred with the use of the hot tub or any other equipment hired.
Your Responsibility When Hiring the Hot Tub
You must be on site to assist us when taking delivery. You must provide us with safe access and clear instructions.
We will not accept any responsibility for any damage or injury caused.
You must provide working electric & water supply close to the set up area and hose with drainage nearby.
Accidents & Injury
As the hirer I accept and acknowledge that I take full responsibility for the use and users of this hot tub and other equipment provided at all times.
Low Fell Hot Tubs will not be liable for accidents, injuries or death.
Low Fell Hot Tubs will not be liable for any accidents relating to use of our hot hubs such as wet surfaces causing slip hazards, running or jumping in and around the spa.
Low Fell Hot Tubs prohibits the use of glass items within the hot tub and will not take responsibility for injury caused by glass breakages within or around the spa area.
CHILDREN UNDER THE AGE OF 16 MUST BE SUPERVISED AT ALL TIMES. Pregnant ladies must seek medical advice before using a spa. Remember this is a hot tub not suitable as a birthing pool.
Do not use any electrical items within five feet of the hot tub including telephone.
Health & Safety
Please enter the spa with safety in mind at all times, checking the temperature first. Do not jump in or out or dive into the hot tub.
Never enter the hot tub with sharp objects.
Never use glass or any other breakable items within or near the hot tub.
Always where the correct attire when entering the hot tub such as a bathing costume or any swimwear. Never wear shoes or heals as this could cause injury and damage to the spa.
The hirer accepts responsibility for all who use the hot tub that they are in sound medical health. If in doubt please seek medical advice.
The hirer takes responsibility that users are not impaired by alcohol or drugs. The hirer takes responsibility that users are clean when using the hot tub.
The hirer takes responsibility for making sure the hot tub cover is secured back on the tub when not in use. This will not only stop the spa losing heat but will keep the hot tub secure from accidents when not in use
At more than 37.5c you should not spend more than fifteen minutes in the hot tub.
Pregnant women and persons with heart disease, circulatory problems, diabetes or low or high blood pressure should consult a doctor before using the hot tub
You are liable for this hot tub and hot tub cover whilst in your custody for any loss or damage.
We recommend that you contact your household insurance company to inform them of this hire and ask them to provide cover.
General Use, Upkeep & Chemicals
Never switch the power off. If the power gets accidentally turns off or a power failure occurs please turn it back on in the same way in which you were shown in your demonstration. We will bring you enough chemicals for the duration of your hire; you must use them to keep the spa hygienic as per instructions provided.
It’s really important that everyone is clean when entering the spa. All traces of dirt grease, make up, moisturisers & creams must be removed before using the spa.
When it’s filled with clean water we all want it to stay as clean as humanly possible for both hygiene and unnecessary wear on the pump and spa.
We also sorry to say but if you use a fake tan you cannot use the spa as it will cause lasting discolouration of the spa and result in a damages charge.
If we find the spa unreasonably dirty on collection a fee of £25 will be charged.
DO NOT USE bubble bath or soaps, washing up liquid or any other chemicals within the spa. This also means products such a silly string, glitter, body paints etc these chemicals or foreign objects will ruin the pump. If this occurs it will be classed as gross misuse and we will be looking to reclaim the costs.
If we have to come out to the hot tub whilst on hire to rectify a fault and the fault is found to be down to misuse there will is a £50.00 call out charge
The hot tub will maintain temperature by itself; although during periods of heavy use or when the cover is removed for an extended period there will be a fall in
temperature. Staying out of the hot tub and replacing the cover will allow the water temperature to rise to the desired level.
To change water temperature simply press pad down for cooler and up for hotter.
The hot tub is designed for 6 people. Overloading the hot tub can cause damage for which you will be liable.
When using the hot tub, remove cover and store carefully. Enter water carefully NO JUMPING and make sure it is not too hot (test first).
Over filling the hot tub will cause it to overflow. Each person entering the hot tub will raise the water level by 5-7cm. When the bubbles/jets are activated the water level again rises by a similar amount.
When not using hot tub always replace the cover to retain heat.
Always leave the hot tub plugged in and switched on in order for the filtration/heating systems to work.
It is essential that everyone using the hot tub, showers before use and no foreign bodies e.g. grass; earth, sand, stones or sharp objects are introduced to the water. The hot tub will perform better if kept clean, therefore more enjoyable to use.
Damages to your Property
Low Fell Hot Tubs will not be held responsible for any damages to your property through the entire hire period. This includes weight or water damage to any or all structure, fixings & fittings, garden or grass areas. It is your responsibility to make sure that the space provided is fit for purpose.
Liability
On agreeing a delivery / collection time on the given date we will not be held responsible or
liable for any delays that are out of our control.
If a hot tub stops working you must notify us immediately so we can be given the opportunity to identify the problem and resolve it.
We will not be held responsible for damage to persons or property.
Lost, Stolen, Damaged or Unclean Hot Tub
It is you the hirer who responsible for returning the spa in the same condition in which you received it.
You will be held responsible for a lost, stolen or damaged whether it’s minor damage or damaged beyond economical repair.
If you do not willingly pay the costs we will pursue you through the courts.
Our Right of Access
I the hirer do hereby give Low Fell Hot Tubs the right to enter the premises or land where they believe the hot tub to be on the agreed date and time of the collection.
Other
If any of the terms in the above contract aren’t acceptable then our hot tub service will not be supplied.
By signing this contract you the hirer agree the release of Low Fell Hot Tubs or any of
its employees from any and all liability.
On hiring and signing this contract you the hirer agree to and accept all of the terms and conditions and acknowledge that the use of the hot tub is at you the hirers own risk
Covid-19 Policy
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Low Fell Hot Tubs has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Low Fell Hot Tubs can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families.
I voluntarily seek services provided by Low Fell Hot Tubs and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while using the services of Low Fell Hot Tubs.
I attest that:
I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
I have not travelled internationally within the last 14 days.
I have not travelled to a highly impacted area within the United States of America in the last 14 days.
I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold Low Fell Hot Tubs harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the company, or that may otherwise arise in any way in connection with any services received from Low Fell Hot Tubs. I understand that this release discharges Low Fell Hot Tubs from any liability or claim that I, my heirs, or any personal representatives may have against the salon with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Low Fell Hot Tubs. This liability waiver and release extends to all owners, partners, and employees.
