TERMS AND CONDITIONS

Freddie Douglas & Co Ltd

These Terms and Conditions supersede and replace all previous versions issued by Freddie Douglas Events and Low Fell Hire.

  1. About Us

These Terms and Conditions govern all services supplied by Freddie Douglas & Co Ltd (“the Company”, “we”, “us”, “our”).

Freddie Douglas & Co Ltd owns and operates the following trading brands:

  • Freddie Douglas Events
  • Low Fell Hire

Any booking made through either trading name is a contract with Freddie Douglas & Co Ltd and is subject to these Terms and Conditions.

  1. Services

We provide a range of event services including, but not limited to:

  • Wedding Planning
  • On-the-Day Coordination
  • Wedding Content Creation
  • Venue Styling
  • Prop Hire
  • Light-Up Letters & Numbers
  • Neon Signs
  • Audio Guest Books
  • Backdrops
  • Event Décor
  • Delivery, Installation and Collection

All services are subject to availability.

  1. Quotations

All quotations are valid for 14 days from the date issued.

Prices may be revised after this period.

Where applicable, a minimum hire spend may apply depending on the venue or location. This will be confirmed within your quotation.

  1. Booking Fee & Payment

4.1 Booking Fee

non-refundable booking fee of £100, or another agreed amount depending on the services booked, is required to secure your event date.

For larger hire bookings, a booking fee of 25% of the total booking value may be required.

Where applicable, delivery charges are payable in full at the time of booking.

Your booking is not confirmed until these payments have been received.

4.2 Final Payment

The remaining balance must be paid in full no later than 28 days before your event.

Failure to make payment by the due date may result in cancellation of your booking.

4.3 Late Payments

Late payments may incur administration charges together with statutory interest under the Late Payment of Commercial Debts legislation where applicable.

4.4 Additional Services

Any additional items or services requested after booking are subject to availability and additional charges.

Payment for additional services may be required before they are supplied.

  1. Changes to Bookings

All booking changes must be requested in writing.

Whilst we will always try to accommodate amendments, we cannot guarantee:

  • additional hire items;
  • replacement items;
  • changes of date;
  • alterations during peak periods.

Additional costs may apply.

  1. Cancellation Policy

All cancellations must be made in writing.

More than 8 weeks before the event

The booking fee remains non-refundable.

Any further payments made may be refunded, less any costs already incurred.

Within 8 weeks of the event

No payments will be refunded.

Within 28 days of the event

The full remaining balance remains payable.

Should your booking reduce after confirmation, the original booking fee remains based upon the original booking value and is not refundable.

  1. Failure to Pay

Failure to make payment by the agreed dates constitutes a breach of contract.

Freddie Douglas & Co Ltd reserves the right to:

  • cancel your booking;
  • retain all monies already paid;
  • recover any outstanding balance;
  • reallocate products and services without notice;
  • pursue recovery of any losses arising from the cancellation.
  1. Venue Access

The Client must ensure:

  • unrestricted access to the venue;
  • suitable parking for loading and unloading;
  • sufficient setup and collection time;
  • a safe working environment;
  • any access restrictions are disclosed before booking.

This includes:

  • stairs;
  • lifts;
  • restricted parking;
  • timed loading bays;
  • difficult entrances;
  • venue restrictions.

Failure to advise us may result in additional charges.

  1. Hire Equipment

Ownership

All hire items remain the property of Freddie Douglas & Co Ltd at all times.

Security Deposit

Certain hire items may require a refundable security deposit.

This will normally be returned within seven days following collection, provided all items are returned in satisfactory condition.

Damage, Loss or Theft

The Client is responsible for hired items from delivery until collection.

Charges will apply for:

  • damage;
  • breakages;
  • missing items;
  • theft;
  • excessive cleaning;
  • vandalism.

Replacement costs will be invoiced where appropriate.

Late Returns

Items retained beyond the agreed collection date may incur daily hire charges until returned.

  1. Health & Safety

The Client agrees that:

  • electrical equipment will only be used as instructed;
  • extension reels will be fully unwound;
  • illuminated props will stand on level surfaces;
  • bulbs will only be changed when unplugged and cool;
  • heavy props will be moved by two adults;
  • no repairs will be attempted by the Client.

Outdoor use of electrical hire equipment is only permitted with prior written approval and is subject to weather conditions.

  1. Content Creation & Photography

Unless agreed otherwise in writing before the event, Freddie Douglas & Co Ltd reserves the right to use photographs and video content from your event for:

  • marketing;
  • social media;
  • advertising;
  • website galleries;
  • printed materials;
  • portfolios.

Should you prefer your event not to be featured, this must be confirmed in writing before your event.

The Client is responsible for obtaining any necessary guest consent for photography or filming.

  1. Audio Guest Book

Audio Guest Books are tested before installation.

Freddie Douglas & Co Ltd accepts no responsibility for missing recordings where equipment has been:

  • switched off;
  • unplugged;
  • moved;
  • tampered with;
  • damaged after installation.
  1. Supplier Substitutions

Should circumstances beyond our control prevent the use of a specific item or supplier, Freddie Douglas & Co Ltd reserves the right to substitute products or suppliers with suitable alternatives of similar quality and value.

  1. Client Delays

Should setup or collection be delayed due to venue restrictions, delayed access or actions of the Client or venue staff, additional waiting time charges may apply.

  1. Liability

Whilst every care is taken, Freddie Douglas & Co Ltd accepts no responsibility for:

  • adverse weather;
  • venue closures;
  • supplier failures;
  • power failures;
  • traffic delays;
  • acts of God;
  • government restrictions;
  • force majeure events.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot legally be excluded.

Subject to the above, our total liability arising from any booking shall not exceed the total amount paid by the Client for the relevant services.

We strongly recommend all clients obtain comprehensive wedding or event insurance.

  1. Force Majeure

Neither party shall be liable for failure to perform their obligations where prevented by circumstances beyond reasonable control including but not limited to:

  • pandemics;
  • severe weather;
  • flooding;
  • fire;
  • terrorism;
  • civil unrest;
  • industrial action;
  • government restrictions.

Where possible, we will work with the Client to rearrange the booking. Refunds may not be available.

  1. Intellectual Property

All content, photographs, videos, designs, styling concepts, documents, branding, logos and marketing materials created by Freddie Douglas & Co Ltd remain our intellectual property unless otherwise agreed in writing.

They may not be copied, reproduced or used commercially without our written permission.

  1. Privacy

Freddie Douglas & Co Ltd processes personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Your information will only be used to administer your booking and fulfil our contractual obligations. We will not sell your personal information to third parties.

Our full Privacy Policy is available upon request or via our website.

  1. Client Responsibilities

The Client agrees to:

  • provide accurate booking information;
  • notify us of any changes to timings or venue access;
  • provide suitable power supplies where required;
  • supervise children around hire equipment;
  • ensure guests do not climb, sit or hang from hired items;
  • take reasonable care of all equipment during the hire period.
  1. Governing Law

These Terms and Conditions shall be governed by the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Agreement

By paying the booking fee or confirming a booking with Freddie Douglas & Co Ltd, you confirm that you have read, understood and accepted these Terms and Conditions.
